These Terms of Use govern your access to and use of the TSPC website (goturbo.ca), the Xplore Recreation member portal and mobile application, and any related digital services operated by Turbo Sports and Performance Centre Corp. (“TSPC,” “we,” “our,” or “us”). By accessing or using any of these services, you agree to be bound by these Terms.
These Terms of Use apply alongside our Privacy Policy, facility waivers, and any program-specific agreements you enter into with TSPC. In the event of a conflict, program-specific agreements take precedence.
To create an independent account with TSPC through Xplore Recreation, you must be 16 years of age or older. To register for the Adult Sport League through SportsEngine, you must be 18 years of age or older.
Individuals under 16 may access TSPC services only through a family account created and managed by a parent or legal guardian who is at least 18 years old. By creating a family account that includes a minor, the Account Holder represents that they have legal authority to act on the minor’s behalf.
You agree to provide accurate, current, and complete information when creating an account. You are responsible for maintaining the accuracy of your account information and for the security of your account credentials. TSPC is not liable for losses resulting from unauthorized access to your account due to your failure to maintain credential security.
Creation of an account through Xplore Recreation requires acceptance of TSPC’s Facility Terms and Conditions and Waiver of Liability. Registration in the Adult Sport League through SportsEngine requires acceptance of a separate league waiver. These waivers are incorporated into your agreement with TSPC.
You agree to use TSPC’s services only for lawful purposes and in accordance with these Terms. You agree not to:
A booking or registration is confirmed only upon receipt of payment and a confirmation notice from TSPC or the applicable platform. TSPC reserves the right to cancel or modify bookings in the event of facility unavailability, scheduling conflicts, or circumstances beyond our control.
Cancellation and refund terms are governed by the specific policies associated with each product type (membership, league registration, facility rental, program). These policies are presented at the point of purchase and are incorporated into these Terms by reference. General refund inquiries should be directed to info@turbosportsperformance.com.
All payments are processed through Moneris Solutions Corporation. By providing payment information, you authorize TSPC to charge the applicable fees through Moneris. TSPC does not store raw payment card information. Moneris’s own terms and PCI-DSS compliance govern the security of your card data during processing.
Use of TSPC’s physical facility is subject to facility rules posted on-site and available at goturbo.ca. These include but are not limited to:
TSPC reserves the right to remove any individual from the facility or suspend/terminate their account for conduct that violates facility rules, poses a safety risk, or is otherwise inappropriate, at our sole discretion.
All content on goturbo.ca, including text, graphics, logos, photographs, video, and software, is the property of Turbo Sports and Performance Centre Corp. or its licensors and is protected by Canadian copyright, trademark, and intellectual property law.
The TURBO wordmark, logomark, and lockup are registered trademarks of Turbo Sports and Performance Centre Corp. (CIPO filing November 5, 2025). Unauthorized use of TSPC’s trademarks is prohibited.
You may not reproduce, distribute, modify, or create derivative works from TSPC’s content without our express written consent.
To the maximum extent permitted by applicable law, TSPC, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TSPC’s services, website, or facility, except where such liability cannot be excluded by law.
TSPC’s total liability for any claim arising from these Terms or your use of our services shall not exceed the amount paid by you to TSPC in the 12 months preceding the claim.
Nothing in these Terms limits TSPC’s liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Our services integrate with third-party platforms including Xplore Recreation, SportsEngine, Moneris, and others described in our Privacy Policy. Your use of these platforms is also subject to their respective terms of service and privacy policies. TSPC is not responsible for the practices of these third-party providers.
TSPC may update these Terms of Use at any time. We will provide reasonable notice of material changes by email or through a notice on goturbo.ca. Continued use of our services following notice of a change constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
